ZentoCare, a healthcare SaaS platform by Zentosys Solutions Pvt. Ltd. These Terms of Use, together with our Privacy Policy, govern your use of our website, web portal, and mobile applications (collectively, the “ZentoCare Platform”). By using our services, you agree to these terms.
1. Eligibility & User Consent
- You must be at least 18 and legally able to enter contracts. Registration on behalf of a clinic or organization confirms authorization to bind that entity.
- By registering, you consent to receive transactional (e.g., confirmations, reminders) and promotional communications via email, SMS, WhatsApp, or in-app notifications, with opt-out options provided.
- Use of the Platform by persons under 18 is permitted only under the supervision of a parent, guardian, or authorized caregiver.
2. Permissions & Device Access
- ZentoCare’s app may request access to camera, files, external storage, or device contacts to support features such as document upload, teleconsultation, profile management, and vital monitoring.
- You may choose to grant or revoke such permissions at any time via your device settings.
3. Data Collection & Use
- We collect personal, medical, appointment, usage, and device metadata as needed to provide and improve our services. Non-personally identifiable data may be aggregated for analytics or research.
- We use cookies and similar technologies on web platforms to preserve your preferences and enhance user experience.
- We do not sell personal data to third parties. Data may be shared with service providers or partners strictly for platform functionality, under confidentiality agreements.
4. Patient-Doctor Interactions & Liability
- The ZentoCare Platform provides tools to facilitate doctor-patient communication and information-sharing. It does not replace professional medical advice or emergency care.
- Do not use ZentoCare for emergencies—always seek immediate in-person assistance. We disclaim liability for harm resulting from reliance solely on our platform for urgent medical conditions.
- ZentoCare does not verify or endorse the qualifications of healthcare providers using the platform. All medical decisions are the sole responsibility of the healthcare provider and the patient.
5. Accounts & Proxy Access
- You’re responsible for safeguarding your account credentials. Notify us immediately of unauthorized use.
- Proxy access (e.g., caregivers or parents accessing patient information) may be enabled only with explicit, legally valid authorization.
- ZentoCare assumes no liability for misuse of proxy access if granted without appropriate authorization.
6. Content & License
- Users retain ownership of any content they upload, but grant ZentoCare a worldwide, perpetual, royalty-free license to process and display it as part of the service.
- You authorize ZentoCare to use aggregated, anonymized information for analytics, research, or business purposes.
7. Prohibited Conduct
- You agree not to use the Platform to conduct illegal activities, infringe intellectual property, upload harmful content, reverse-engineer our software, or misuse the services.
- You must not interfere with or disrupt the Platform's security features or attempt unauthorized access to any part of the system.
8. Subscriptions & Payments
- Our service operates on a subscription basis, with detailed pricing provided online or in proposals.
- Fees are non-refundable unless explicitly stated. Delayed payments may result in restricted access or suspension.
- All applicable taxes and levies shall be borne by the subscriber unless specified otherwise.
9. Security & Confidentiality
- We implement reasonable security protocols—including industry-standard encryption during data transmission and storage—to protect data integrity.
- Despite protective measures, we cannot guarantee absolute security against all unauthorized access.
- Users are encouraged to implement additional safeguards such as strong passwords and device protection.
10. Third‑Party Integrations
- ZentoCare may integrate with third-party services (e.g., WhatsApp gateways, cloud storage, SMS providers). We are not responsible for failures or data issues arising from these integrations.
- Your use of third-party services is governed by their respective terms of use and privacy policies.
11. Termination & Account Closure
- We may suspend or terminate your account for policy violations, non-payment, legal obligations, or violation of these terms.
- Upon termination, your data may be retained in compliance with legal requirements and our data retention policy.
- Users may also request voluntary account closure by contacting support, subject to data retention laws.
12. Amendments & Notices
- We reserve the right to modify these terms. You will receive notification of any material changes. Continued use after updates constitutes acceptance of the new terms.
- Communications may be sent via email, app notifications, or website notices.
13. Dispute Resolution & Governing Law
- These Terms are governed by Indian law. Exclusive jurisdiction lies with Pune courts.
14. Indemnification & Liability Limitation
- You agree to indemnify Zentosys Solutions Pvt. Ltd. from claims resulting from your misuse of the Platform.
- Except as required by law, we disclaim all warranties; provide the service “as‑is.” To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages.
15. Emergency Warning
- ZentoCare is not a substitute for emergency or life-saving medical services. In urgent situations, please contact emergency services directly.
16. Platform Availability & Maintenance
- We strive to ensure continuous availability of the Platform, but we do not guarantee uninterrupted service. We reserve the right to perform scheduled or unscheduled maintenance or updates.
